Lawfare is the most recent front to open in the battle for democratic society in Europe. Across the continent, questions are asked about the rule of law. However, these debates differ from state to state. In some countries the rule of law debate is a matter of how to tackle the question of judicial activism – with judges acting well beyond their mandates. In other countries it is a question of whether the government are accountable to the judiciary. And in some it is a question of if the constitution is upheld at all.
